Terms of Service

1. Parties and Acceptance

These Terms of Service (“Terms”) form an agreement between Melda İğde (“we”) and you (“user”), who uses the Mially app (the “app”). By downloading or using the app, you accept these Terms. If you do not accept them, do not use the app.

2. Description of the Service

Mially is a mobile app offering calorie and nutrition tracking, voice/barcode/photo food entry, a Turkish cuisine food database, and AI-assisted nutrition/workout plans. Features may change over time.

3. Your Account and Responsibilities

You must be at least 13 years old to use the app; if you are under 18, you may use it only with the consent of a parent or guardian. You are responsible for providing accurate information and for the security of your account. You are responsible for activity under your account. You may not use the app for unlawful purposes, in ways that infringe others' rights, or to abuse the system (automated access, reverse engineering, excessive requests).

4. Medical Disclaimer — Important

Mially is a health and wellness tool; it is not a medical device or medical advice. The calorie values, plans, and suggestions it provides are for informational purposes only and do not replace advice from a doctor, dietitian, or health professional.

• Consult a health professional before changing your diet or exercise program.
• If you are pregnant, have a chronic illness, a history of an eating disorder, or any medical condition, consult your physician before using the app.
• AI-generated content (nutrition analysis, plans) may contain errors; accuracy is not guaranteed.

In a medical emergency, call your local emergency number, not the app.

5. Subscriptions and Payments

Alongside free features, the app offers an auto-renewing subscription called Mially Premium.

• Plans: Monthly and yearly. The current price is shown in your local currency on the in-app subscription screen before you purchase.
• Free trial: New subscribers get a 7-day free trial. The trial starts when you start the subscription. Unless you cancel at least 24 hours before the trial ends, the price of the plan you chose is charged when the trial ends and the subscription begins. Each account can use the free trial once.
• Payment: Payment is charged to your Apple ID account (App Store) or Google account (Google Play) at confirmation of purchase (or at the end of the free trial, if any).
• Auto-renewal: The subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing and cancelling: You can manage your subscription and turn off auto-renewal in your store account settings after purchase (iPhone: Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current period; you keep Premium access until then.
• Refunds: Because payments are processed by the App Store / Google Play, refund requests are handled per the relevant store's policy. Any unused portion of a free trial is forfeited when you purchase a paid subscription.

5a. Additional Terms for App Store Users

If you downloaded the app from the Apple App Store, Apple's Standard End User License Agreement (EULA) also applies in addition to these Terms: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ . These Terms are between you and us, not Apple; we, not Apple, are responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

6. Intellectual Property

The app, its design, logo, content, and the name “Mially” belong to us and are protected by copyright and trademark. You may not copy, distribute, or create derivative works of the app beyond your personal use. Data you enter (food logs, etc.) belongs to you.

7. Service Availability

We reserve the right to improve, change, or discontinue the service. We do not guarantee that the app will operate uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app. Our total liability is limited to the amount you paid to the app in the last 12 months.

9. Termination

We may suspend or close your account if you breach these Terms. You may also close your account anytime via Settings → Data deletion request.

10. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. The courts of Antalya/Alanya have jurisdiction; consumer arbitration boards/courts remain reserved for consumer transactions.

11. Changes and Contact
